Big Steps Little Feet Terms & Conditions

1. Our agreement with you
1.1 As a customer of Big Steps Little Feet Pty Ltd ["Big Steps"] these terms and conditions form the basis of your agreement with Big Steps. 
1.2 Big Steps' agreement with you also includes your enrolment form which you complete and provide to Big Steps.

2. Refunds, Discounts and Credits
2.1 No refunds or discounts or credits are given for missed classes for any reason. If you miss a class due to holiday or illness Big Steps can offer a make-up class, these classes are to be arranged with Big Steps and attended within the same term as the absence.
2.2 If your child commences daycare, preschool or any other activity on the day that you have enrolled into a Big Steps class you will not be granted a refund or credit. You can however attend a makeup lesson on another day within the same term as the absence. 

3. Holiday's and extended time away

3.1 Our classes run for 40 weeks of the year, for 12 weeks of the year our classes are not scheduled.
3.2 We encourage you to take holidays or have extended trips away during the regular breaks we have throughout the year, when our classes are not running.
3.3 If you decide to have holidays or extended time away when our classes are running that is totally okay but please note, credit or refunds or discounts or reduced fees or part payments are not offered. This includes absences between trial enrolment to full enrolment confirmation and payment.

3.4. If you have been away for the start of the term you are more then welcome to rejoin our classes once you return from your trip. The term fees move into pro rata mode from week 4 of each term. 

4.Class Procedure
4.1 Big Steps request that children are taken to the toilet before their class commences to avoid disruption to the classes. 
4.2 All Big Steps classes/locations are nut free zones. Big Steps also has a no sharing of food policy; please ensure that you pack enough nut free snacks for your child only to consume.
4.3 Please be punctual in arrival and ensure your child is collected on time as Big Steps is not responsible for the safety of children outside their class times. 
4.4 Big Steps reserves the right to exclude students and parents whose behaviour is disruptive or abusive. This includes viewing or participating parents who talk throughout the lesson. 
4.5 Unless otherwise stated, for Big Steps to maintain a controlled and positive teaching environment, classes during the term are closed to all visitors. This includes when it's raining, hot or cold or night time. 
4.6 For classes of 2 year olds and under and many 2/3yrs classes, parent participation is required. 
4.7. Parent participation requires you to be physically able to join in from start to finish as directed or when needed - if a baby/sibling is present the parent/carers ability to meet the needs of the dancing child is compromised and not recommended. Babysitting arrangements are recommended. 
4.8 Big Steps is unable to accommodate non-enrolled siblings to watch or join in. 
4.9 Mobile phones are to be switched off.

5. Costs
5.1 Students are invited to participate in exams, presentations and annual concerts all of which will incur additional charges including but not limited to; exam/presentation fees, pianist fees, formal uniform purchase, extra rehearsal fees, costume purchase, concert ticket purchase, video purchase, photograph purchase. Please feel free to chat with director Kate Barber about what to expect financially for the additional charges. Signing below confirms that you agree to pay the price set by Big Steps for these items as set by Big Steps, irrespective of whether you have discussed with Big Steps. 

5.1.1 CONCERT COSTS: The range of prices to be expected around concert time is as follows: Costume $90 - $130 per costume, Tickets $44 per adult $22 per child, Video Download $23 or DVD $66, Tights $20, Optional Merchandise - Bags $25 T-Shirts $35.00. You may also be required to purchase particular underwear, ribbons, ballet shoe paint (or new shoes if they are in bad condition), hair accessories and optional makeup.
5.1.2 The compulsory concert costs are costumes, tickets for audience members, a download of video, ballet tights, underwear, ballet shoes and any additional items stated by Big Steps.
5.1.3 Participation in the concert is voluntary; for those families, parents and/or children that do confirm concert participation they do so knowing that there are additional costs and compulsory purchases associated. And the parent or guardian agrees to pay the additional costs and compulsory purchases as set by Big Steps prior to the commencement of Term 4.

5.2 Big Steps reserves the right to cancel or change the timetable and price structure at any point in time. 
5.3 All cheques that are returned/dishonoured will incur a $35 fee and the total must be repaid by cash or direct deposit/internet transfer. 
5.4 A 2.5% surcharge is added to all credit card payments. 
5.5 Sibling discounts and multi class discounts are only applied to the cheaper class and are only applied to FULL enrolments that are paid in full.

5.6 Trial Pack

5.6.1 The trial pack allows you to trial our programs before committing to the term, you are under no obligation to continue if you are dissatisfied with any aspect of the classes.
5.6.2 The trial pack is non-refundable even if only part of the trial has been taken.
5.6.3 To take up our offer of a trial pack you must pay with your credit card only and this entitles your child to two lessons and includes registration fee of $25 and insurance of $5.
5.6.4 The balance of the term is payable on or after your second lesson, otherwise you will use your spot in the class. The $20 already paid in the trial is automatically deducted from the total term fees in the checkout window. 
5.6.5 The trial enrolment to full enrolment is sequential. If you enrol for a trial, and then miss classes before deciding to enrol for the remainder of the term, credit will not be applied or discounts offerred for the missed classes. You will need to pay for the remainder of the term, less $20 from the trial pack payment. You are able to make up the missed classes.
5.6.6 If you enrol for a trial but do not continue for the remainder of the term, the $50 trial payment covers the cost of the 2 lessons attended. If you enrol again in FULL at a later date, the registration and insurance is applied and payable at the time of the FULL enrolment. 
5.6.7 If your children take up the offer of a trial pack (which in effect is a split/part payment) no discounts are applied as mentioned in 4.5.

6. Communications
6.1 Big Steps will communicate with you primarily by email and you consent to receive information from Big Steps via email. Big Steps will not provide your details to any other company, entity or organistion unless consented to by you and all information will be kept by Big Steps in accordance with The Privacy Act.
6.2 Big Steps will use its best endeavours to ensure that all communications are virus free, however, Big Steps is not responsible for any loss of damage suffered by you in the event that a virus or like issue is transmitted unknowingly by Big Steps.

7. Working with Children
7.1 All employees, contractors, sub-contractors or directors of Big Steps have a working with children certificate as required by relevant legislation from time to time.

8. Limit of Liability
8.1 Big Steps do not exclude or limit - 
(a) the application of any provision of any statute (including the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of this clause 7 to be void; or 
(b) direct losses and damages which arise only as a result of Big Stepn's gross negligence (which means where Big Steps commits an act or allows an omission to occur in reckless disregard the consequences of the act or omission). 
8.2 Except where clause 7.1 applies, Big Steps excludes all statutory liability, tortious liability (including but not limited to liability in negligence), the general law or statute, liability for all direct, economic, consequential or indirect losses, expenses, damages and costs incurred by you, arising out of or relating to the attendance at class, including, but not limited to, liability for gross negligence and except to the extent of clause 7.1(a), Big Steps is not responsible or liable for any indirect consequential or economic damages.

9. Video/Photography
9.1 At the end of each term you are invited to watch your child's dance class. Please remember to silence your mobiles and make alternative care arrangements for siblings. 
9.2 Prior to photographing and/ or videoing any class please seek permission from the teachers and the other family members in the class.
9.3 Any recording or photography is for personal use only and not be for commercial sale.
9.4 Any recording or photography is not to be uploaded onto the internet, social networks &/or video/photo sharing sites.

10. Talent Release
10.1 Grant of Rights. Upon enrolling my child into a class, a workshop, a concert or any event at Big Steps, I hereby grant to Big Steps the absolute and irrevocable right and permission, throughout the world, in respect of the photographs and/or video footage ("the material") that it has, has taken, or has had taken of my child or in which my child may be included with others: 
10.2 To use, re-use, publish, and re-publish, and otherwise reproduce, digitise, edit, modify, distribute in print and online, publicly display in print and online, share via social media, and publicly perform the same, in whole or in part, individually or in conjunction with other photographs or videos, and in conjunction with any copyrighted matter, in any and all media now or hereafter known, for illustration, website, promotion, art, marketing, advertising and trade. 
10.3 Release. Upon enrolling my child into a class, workshop, concert or any event at Big Steps, I hereby release and discharge Big Steps from any and all claims and demands arising out of or in connection with the use of the photographs or footage, including without limitation any and all claims for defamation, invasion of privacy, and misappropriation of my right of publicity. I hereby by waive any claim that I may have to inspect or approve any images, products or copy in connection with any of the material. 
10.4 Copyright in the Material. Upon enrolling my child into a class, a workshop, concert or event organised by BSLF. I acknowledge that I have no claim to the copyrights in the Material. The copyright owners have the right to copyright the Material in their own names or otherwise and to use, assign, and license the Material throughout the world, including any rights I might have. 
10.5 Representations. I have read the foregoing and fully understand the contents thereof section 9 Talent Release. This release shall be binding upon me and my heirs, legal representatives and assigns. I further release Big Steps from any responsibility for injury incurred during any and all past, present or futures photography and/or video sessions and activities.

11. Consent
11.1 Dance is a physical activity and the teacher or teaching assistant may have to assist your child's understanding of an action, posture or position by physical contact eg. holding hands in a circle; lifting, correcting posture. You consent to employees, sub-contractors, contractors and directors of Big Steps having contact with your child in this regard. 
11.2 You consent to employees, sub-contractors, contractors and directors of Big Steps taking your child to the toilet during class if your child requires to use the toilet. The children must be independently able to use the toilet, the staff will call you if any further assistance is required.
11.3 Should your child hurt his/herself you consent to employees, sub-contractors, contractors and directors of Big Steps to attend to your child whilst Big Steps wait for the nominated guardian to take over. 
11.4 Your child's enrolment into a Big Steps class is voluntary and participation in the class and the activities of ballet, creative movement and dance involve numerous risks of injury, including but not limited to muscle strains, sprains and falls and you freely assume these risks for your child(ren.) as outlined in clause 7.
11.5. You must inform Big Steps and all teaching staff of any injuries, medical conditions, allergies your child suffers from each week at class.

Please read this document carefully and thoroughly. Especially the new information below about our COVID Safe Policies. Ticking the box here online confirms your acceptance of all clauses in the terms and conditions document including release of liability of Big Steps and its employees, contractors, sub-contractors and directors for any and all injuries caused by participation in a class or the activities of ballet, creative movement and dance whether or not such injury was caused by alleged negligence.

12. CORONAVIRUS TERMS AND CONDITIONS 

Baby Ballet will be capped at 10 students & 10 parents, complying with the 1.5m social distancing protocol

Rainbow Ballet, Classical Ballet and Lyrical Jazz will be capped at 16 students, and we will be adopting the 'Arrive/Dance/Leave' policy.

The ‘Arrive/Dance/Leave’ approach means children are to arrive prepared, changed into ballet clothes if possible, and minimal use of shared facilities. Parents are to drop off child into the hall (or at the door) and leave when instructed to do so by your teacher. And again when collecting your child.

Parents (not in Baby Ballet) will be required to 'drop and go', no adults are allowed to stay and watch or enter the hall at any time whilst a class or cleaning is in progress. (However, my disclaimer on this is: If your child hurts themselves, gets really upset or needs your assistance with going to the bathroom, I will call you on the number provided and you will have to come and collect them from class.)

This means that if your child has separation issues, wants you to be with them, needs you to stay for first 5-10 minutes, watch last 5 minutes etc... you will sadly be unable to do so. My suggestion is to enrol them into a Baby Ballet class, which allows you to stay and watch and support all of their needs throughout the session.

If your child is unwell, particularly if coughing or sneezing, please DO NOT attend any classes. All make up classes will be online via zoom at set dates throughout the term. Credit or refunds for missed classes for any reason will not be available.

Booking online via the Big Steps Little Feet website is ESSENTIAL to ensure you don’t miss out.

Drop in casual classes or drop in visitors are not permitted.

If there is a class finishing up before your class, please wait until everyone has left the room before entering the hall space

Please use hand sanitiser (provided) when first entering the space and leave your name and contact details in a book provided

Please maintain the 1.5m social distancing at all times. This includes when entering / exiting the studio and when placing/collecting your child's belongings down or using the bathroom

Please bring an INEXPENSIVE water bottle for your child and everything they will need for class (borrowing of ballet shoes for the time being is not allowed).

All water bottles, toys and hair items (ie hair elastics, head bands) left behind will be discarded into the bin at the end of each class during the cleaning process.

If your child wants to bring items for 'show & tell' please make sure they are not precious toys. My suggestion is to bring something from nature, or a hand drawn picture. An item that can be discarded if forgotten at the end of class.

Please be diligent with labelling all items of clothing especially wraps and cardigans that children often remove once warm.

We will keep the room lightly heated so its snug and warm through winter.

No socialising before or after class (or whilst classes are in progress) immediately outside the premises. We suggest you do all of this in parks or cafe’s adjacent to the halls.

No spectators are allowed. Non essential adults, including parents are excluded from watching the lessons.

There will be no parent viewing at the end of each term and all new students on a trial will have to take the class without a parent watching them (unless it's a Baby Ballet class of course.)

Zoom Classes

All missed classes - from here on in - due to illness, holidays or for any other reason will be made up via Zoom. These make up classes will be scheduled throughout the term on a set date and time. If you are unable to make the zoom class, it will be recorded and kept available for two weeks allowing your child to watch and participate in their own time.

Credit or refunds for missed classes will not be available for any reason. All make up classes will occur over zoom.

Parents will be unable to chat with the teacher in between classes, please send an email, organise a phone or zoom meeting if you want to discuss any aspect of your child’s participation in class.

Thank you for your understanding in observing these guidelines to help everything run as smoothly and safely as possible, a complete COVID Safe plan is available on our website, reading this document, along with the Term & Conditions will be a requirement of enrolment.

Also to note..

There are no credit or refunds for any classes not attended in Term 1 due to Caronavirus restrictions, illness or holidays or for any other reason. There are 3 pre-recorded Baby Ballet and Rainbow Ballet classes available, please contact me if you have not received them.

All Active Kids and Creative Kids vouchers submitted but not used will be available as normal as credit on your account.
